Explication de Texte (2\u00e8me partie)"},"content":{"rendered":"\n<p>Pour continuer l&rsquo;explication du r\u00e8glement du temps de travail des personnels de la ville de Paris, l&rsquo;UNSA vous propose sa deuxi\u00e8me fiche explicative consacr\u00e9e aux suj\u00e9tions.<\/p>\n\n\n\n<p><a href=\"https:\/\/unsa-paris.fr\/savp\/wp-content\/uploads\/2022\/06\/ABB_Fiche_pratique_2_definition_des_sujetions.pdf\">Fiche pratique 2 d\u00e9finition des suj\u00e9tions\u00a0 \u00a0T\u00e9l\u00e9charger<\/a> \u00a0<\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-bright-red-color\"><strong>Les suj\u00e9tions<\/strong> <br><strong>Ce qu&rsquo;il faut savoir\u00a0<\/strong><\/mark><\/p>\n\n\n\n<p>Une suj\u00e9tion est une r\u00e9duction d\u00e9rogatoire du temps de travail annuel, \u00e9tablie en fonction de la p\u00e9nibilit\u00e9 li\u00e9e \u00e0 la nature des missions et \u00e0 la d\u00e9finition des \u00a0cycles de travail qui en r\u00e9sultent.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p><strong>CE QUE DIT LA LOI\u00a0: Article 2 du d\u00e9cret n\u00b02001-623 du 12 juillet 2001<\/strong><\/p>\n\n\n\n<p>\u00ab\u00a0L&rsquo;organe d\u00e9lib\u00e9rant de la collectivit\u00e9 ou de l&rsquo;\u00e9tablissement peut, apr\u00e8s avis du comit\u00e9 technique comp\u00e9tent, r\u00e9duire la dur\u00e9e annuelle de travail servant de base au d\u00e9compte du temps de travail d\u00e9fini au deuxi\u00e8me alin\u00e9a de l&rsquo;article 1er du d\u00e9cret du 25 ao\u00fbt 2000 susvis\u00e9 pour tenir compte <strong>de suj\u00e9tions li\u00e9es \u00e0 la nature des missions et \u00e0 la d\u00e9finition des cycles de travail qui en r\u00e9sultent, et notamment en cas de travail de nuit, de travail le dimanche, de travail en horaires d\u00e9cal\u00e9s, de travail en \u00e9quipes, de modulation importante du cycle de travail ou de travaux p\u00e9nibles ou dangereux.\u00a0<\/strong>\u00bb<\/p>\n\n\n\n<p>Les suj\u00e9tions ne sont limit\u00e9es ni en nombre, ni en dur\u00e9e, mais elles doivent \u00eatre motiv\u00e9es et directement li\u00e9es \u00e0 la nature de la t\u00e2che. C\u2019est le contr\u00f4le de l\u00e9galit\u00e9 de la pr\u00e9fecture qui v\u00e9rifie la validit\u00e9 des suj\u00e9tions propos\u00e9es par les collectivit\u00e9s.<\/p>\n\n\n\n<p class=\"has-bright-blue-color has-text-color\"><strong>D\u00c9FINITION ET ATTRIBUTION<\/strong><\/p>\n\n\n\n<p>C\u2019est le Comit\u00e9 Technique Central qui d\u00e9termine et valide les suj\u00e9tions. Si l\u2019\u00e9volution des m\u00e9tiers ou le changement de cycle de travail n\u00e9cessitent une modification de la suj\u00e9tion attribu\u00e9e, la direction adresse une demande \u00e0 la\u00a0DRH qui l\u2019\u00e9tudie et, en cons\u00e9quence, met \u00e0 jour <strong>l\u2019annexe 4<\/strong> du r\u00e8glement du temps de travail d\u00e9taillant le niveau de suj\u00e9tion par service.<\/p>\n\n\n\n<p class=\"has-bright-blue-color has-text-color\"><strong>LA GRILLE DES SUJ\u00c9TIONS<\/strong><\/p>\n\n\n\n<p>La grille des suj\u00e9tions, adopt\u00e9e lors du Comit\u00e9 Central du 17 avril 2022 (malgr\u00e9 l\u2019opposition des organisations syndicales) et du Conseil de Paris de juin 2022, <strong>qui rentre en vigueur au 1er juillet 2022<\/strong> comprend 7 niveaux. \u00c0 chaque niveau correspond un nombre d\u2019heures de travail annuel. Plus la p\u00e9nibilit\u00e9 du travail est grande, plus le niveau de suj\u00e9tion est \u00e9lev\u00e9, plus la r\u00e9duction du temps de travail est importante.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Niveau de Suj\u00e9tion<\/strong><\/td><td><strong>Obligation Horaire annuelle 2022<\/strong><\/td><td><strong>Rappel ARTT 2001<\/strong><\/td><td><strong>Perte<\/strong><\/td><\/tr><tr><td>0<\/td><td>1607 h<\/td><td>1551 h<\/td><td><strong>-56<\/strong>h<\/td><\/tr><tr><td>1<\/td><td>1580 h<\/td><td>1529 h<\/td><td><strong>-51h<\/strong><\/td><\/tr><tr><td>2<\/td><td>1550 h<\/td><td>1506 h<\/td><td><strong>-44h<\/strong><\/td><\/tr><tr><td>3<\/td><td>1525 h<\/td><td>1484 h<\/td><td><strong>-41h<\/strong><\/td><\/tr><tr><td>4<\/td><td>1505 h<\/td><td>1462 h<\/td><td><strong>-43h<\/strong><\/td><\/tr><tr><td>5<\/td><td>1485 h<\/td><td>1440 h<\/td><td><strong>-45h<\/strong><\/td><\/tr><tr><td>6<\/td><td>1460 h<\/td><td>1418 h<\/td><td><strong>-42h<\/strong><\/td><\/tr><tr><td>7<\/td><td>1435 h<\/td><td>1418 h<\/td><td><strong>-17h<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"has-bright-red-color has-text-color\"><strong>AVIS DE L\u2019UNSA\u00a0:<\/strong><\/p>\n\n\n\n<p>Par l\u2019interm\u00e9diaire des suj\u00e9tions, la ville de Paris aurait pu compenser en totalit\u00e9 la perte des 8 jours de cong\u00e9s impos\u00e9e par la loi de transformation de la fonction publique.<\/p>\n\n\n\n<p class=\"has-text-align-center has-bright-red-color has-text-color\"><strong>La municipalit\u00e9 a manqu\u00e9 d\u2019ambition pour d\u00e9fendre le temps de travail des agents.<\/strong><\/p>\n\n\n\n<p>Elle a refus\u00e9 les propositions de l\u2019intersyndicale \u00ab&nbsp;Pas une minute de plus&nbsp;!&nbsp;\u00bb, qui revendiquait l\u2019augmentation des niveaux de suj\u00e9tion, la possibilit\u00e9 de cumul des suj\u00e9tions et la cr\u00e9ation de nouvelles suj\u00e9tions en plus grand nombre.<\/p>\n\n\n\n<p>L\u2019exemple le plus frappant est celui de la suj\u00e9tion \u00ab\u00a0Travail devant \u00e9cran\u00a0\u00bb qui, si elle avait \u00e9t\u00e9 cr\u00e9\u00e9e, aurait permis \u00e0 tous les agents \u00e0 l\u2019horaire variable de b\u00e9n\u00e9ficier d\u2019une suj\u00e9tion. Si la suj\u00e9tion de trois jours \u00ab\u00a0Ville Capitale\u00a0\u00bb a bien \u00e9t\u00e9 propos\u00e9e par la ville de Paris en juin 2021, puis retoqu\u00e9e par le tribunal administratif, elle n\u2019a pas \u00e9t\u00e9 suffisamment motiv\u00e9e lors de sa pr\u00e9sentation, ni suffisamment compens\u00e9e lors de son retrait.<\/p>\n\n\n\n<p class=\"has-text-align-center has-bright-red-color has-text-color\"><strong>Les chiffres parlent d\u2019eux-m\u00eames\u00a0:<\/strong><\/p>\n\n\n\n<p class=\"has-bright-red-color has-text-color\"><strong>Le r\u00e8glement du temps de Travail 2022 repr\u00e9sente une v\u00e9ritable r\u00e9gression pour les agents parisiens, notamment administratifs.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pour continuer l&rsquo;explication du r\u00e8glement du temps de travail des personnels de la ville de Paris, l&rsquo;UNSA vous propose sa deuxi\u00e8me fiche explicative consacr\u00e9e aux suj\u00e9tions.
